We, the Executive brought a proposal at our September General Meeting to do away with children’s’ gifts for the Christmas party and supply each member with a turkey or ham. We would still have the Christmas Party where the children can play and have entertainment; however they would not receive a gift. All members that attend the Christmas party would receive either a turkey or a ham.
We would like to know from our members what they would like:
1) To continue giving the children gifts
2) To give each member either a turkey or ham who attend the Christmas party.

Re: Grievance Article(s) (2, 32 and 34)
We the Canadian Union of Public Employees Local 110 (Hereinafter called the Union) claim there is a difference between ourselves and the Winnipeg School Division (Hereinafter called the Division).
In that the Division has suspended (A Member) unjustly, and in doing so has misinterpreted and/or misapplied and/or violated Articles 2, 32 and 34 and all other relevant articles covered by the Collective Agreement also Section (80.2) of the Labour Relations Act, and any other acts, statutes or policies as well as Division Policies.
C.U.P.E. Local 110 demands that:
1) That the Division acknowledges that they have misinterpreted and/or misapplied and/or violated articles 2, 32 and 34 and all other relevant articles of the Collective Agreement, also Section 80.2 of the Labour Relations Act, and any other acts, statutes or policies as well as Division Policies.
2) That the Division ceases and desist the misinterpretation and/or misapplication and/or violation of articles 2, 32 and 34 and all other relevant articles under the Collective Agreement, also Section (80.2) of the Labour Relations Act, and any other acts, statutes or policies as well as Division Policies.
3) That the Division pays (A Member) all withheld/suspended pay and reverse the suspension and any other recourse deemed justifiable.

Swaran and Rick have worked very hard regarding the book publication in this time of crisis and should be commended for their work … On behalf of the Membership.

Letter to the Membership of CUPE Local 110
I asked Frank Harder and Mike Martin to attempt to re-negotiate the teeth cleaning part of the Dental package of the Sun life plan.
We, me included have had many problems regarding the way the dentists were billings in this area.
They (Frank and Mike) have just finished negotiating with the Benefits carrier and we have now 4 parts regarding teeth cleaning (that’s up from 3) with no increase to what we are paying.
I asked Swaran Dhaliwal and Rick Peshel to research questions and answers regarding the 5th Class Power Engineers exam.
They (Swaran and Rick) actually published a booklet regarding questions and answers and are printing a few more.
They (The Booklets) will be made available to our Membership in January 2014.
Abe Araya has been involved in many of the Day to Day representations as well as Negotiations re: Member Representations/actions and reactions and is now more involved in all aspects of Union work.
With a few more courses and a little more political involvement there will be no stopping these guys.
You can be very proud of the newer Executive Members; they have picked up the ball and ran with it.
Not only have they been a great support for me. They want to learn and are willing to put in the time.
They have certainly impressed me!

Letter to the Members of CUPE Local 110
Here at Local 110 we the Executives are here to help our fellow members, with our current issues. Rick Pechel (assistant caretaker rep) has taken it upon himself to assist our members on any information you will need about courses, when and where they are available. Give him a call and he will direct you in the right direction.
Swaran Dhaliwal has also agreed to get the information to our members about vacant positions and who filled them.
Frank Harder and Mike Martin want to assist our current and retired members on all issues with our Sun Life benefit plan. The new plan is the same as the old plan. One of most common complaint from our members is the problem with dental issues. Most of the issues are to do with scaling. Your dentist should look at the contract. We all have 3 units of scaling you’re allowed to go twice a year so limit scaling to 1 and a ½ each time.

Letter to the Members CUPE Local 110
The Union and the Division are feeling the shortage of qualified Engineers in a big way.
Like other Unions, we are having a problem finding people who are able to pass the Power Engineers exam and it is now affecting out bargaining unit.
Our positions are starting to down class (Engineers positions are turning into cleaner’s positions) and it is not the Divisions or the Unions’ fault!
We (The Union) have no option but to sit down with the Division and attempt to work out a livable solution regarding a lack of qualified staff (Members).
AS WE CAN NOT ALLOW OUR KEY POSITIONS TO REMAIN EMPTY
Unlike most Unions, Local 110 has always recognized education and/or qualifications over seniority regarding wages and/or job placement, which has helped keep our salaries in an acceptable area for all 110 members ie: we don’t have less then red seal trades and/or engineers in leadership/key positions, while still respecting the seniority clause for all of our skilled labour positions.
We need to keep this up in order to maintain our unique status.
We have a lot to protect!

Letter to the Members CUPE Local 110
Firstly: Thank you for the vote of support (The Notice of Motion) at our last Membership meeting.
Most of the dues increase will be slated for the education of the newer Executive Members.
Secondly: We need out Members to start writing for their 5th Class P Eng tickets, we have a real shortage of qualified Engineers and it is starting to affect the union in a negative way.
Not everyone will pass the first time, maybe not even the second time, but we do need to try.
The Division is also feeling the pinch, and is about to advertise for people with their 5th Class starting almost immediately with little if any time on the sub list.
We (the Executive) are asked by our Members, all the time to support close friends and family members regarding obtaining a position in the Division and we always support this type of move.
However, if you have received support regarding hiring one of “our” people……you should be pushing the individual to write their ticket.
We have a lot to protect here!

The annual Childrens Christmas Party will be held on Sunday, December 8,2013 at RB Russel High School. It commences at 12 noon and goes until 4pm. There will be games, gifts for all the children, and refreshments.
If you have a child or children that are ten years or younger, please forward their names, boy or girl, and ages to Nelson Petrash by November 22,2013 at Cecil Rhodes 2 or fax them to our office at 204-667-8731, or email at local110@mymts.net. We do not have the previous list of names and if I do not receive the names of your children they will not be on the list and could miss out on a gift.
To all members regarding the Childrens Christmas Party that the ages that receive a gift is from new born to 10 years of age. Grand children of members are not eligible to receive a gift from the Union, however Grandparents can bring a gift for their grandchildren and Santa will give them the gift. We encourage all members past and present to come with their families to the Christmas party.

Letter to the Membership of CUPE Local 110
As most all know by now, we (the membership) will be voting on the notice
of motion dealing with ¼ of a percent increase in dues at the next Union
meeting in November.
At the meeting I will be asking for a motion from the floor to suspend all
Business and deal only with the (notice of motion).
In December we will put on the Children’s Christmas party and ……….
At our first meeting in January 2014 we will have prepared a budget and/or a
Schedule (pending the outcome of the vote) regarding exactly what course,
Conferences, conventions, political activities and schools we will be able to
attend.
We have not planned anything for 2014 as of yet as we are unsure of our
budget.
As stated many times over the past year our newer executive members need
an education as well as increased involvement regarding the way we (110)
do business.

A Notice of Motion was submitted to increase Union monthly dues by .25%, submitted by: Abe Araya and Seconded by Frank Harder.
Motion:
It was moved to increase monthly dues by .25% changing Article 10, point #2 to be as:
2. The regular monthly dues of each Local 110 member shall be 1.15% above Cupe National per capita tax of Local 110 Members average monthly salary effective January 1, 2014.
Article 10 Dues and Fees
1. The fee for membership in this Union shall be two dollars ($2.00) and must accompany the application form.
2. The regular monthly dues of each Local 110 member shall be .9% above Cupe National per capita tax of Local 110 Members average monthly salary effective December 1, 2003.
3. If Cupe Local 110 total assets exceed an amount of $75,000.00 for two consecutive months, the Treasurer will Institute a Dues Holiday until the total assets drop below $75,000.00.

Re: (Estoppel 101)
We the Canadian Union of Public Employees Local 110 (hereinafter called the Union) claim there is a difference between ourselves and the Winnipeg School Division (hereinafter called the Division).
In that the Division is now administering article 9 to our detriment, the Union finds it necessary to file the Estoppel below:

Estoppel (1.1):
– The parties have consistently/historically accepted the past interpretation of Article 9.
– The matter was never discussed in negotiations.
– The Union took this as an indication that the practice was working for both parties.
– The Union relied on this practice without detriment.
Therefore:
– We (The Union) assert that the Division is Estopped from varying the practice during the life time of the Collective agreement met between the Winnipeg School Division and CUPE Local 110
